Foundational purposes and activities
Article 5. Foundational purposes
The purpose of the Foundation is to improve the well-being of the inhabitants of its area of activity:
a) defending and protecting the environment by promoting and improving the safety, energy efficiency and use of renewable energy sources in buildings.
b) promoting the rehabilitation of buildings and improving their accessibility.
c) accrediting and approving qualified projects to improve energy security and efficiency and the use of renewable energy sources as well as accessibility in buildings promoted by other public and / or private entities.
Article 6. Activities
To achieve its goals, the Foundation will develop a qualified program of comprehensive renovation of energy and water installations in buildings to achieve maximum efficiency and energy savings, the use of renewable energy sources, as well as an improvement of its accessibility, in such a way that it entails the maximum guarantees and security in all the subjects interested in participating in the program. The qualified program will be carried out through all the activities that the Board deems necessary directly and / or in collaboration with other entities, companies, institutions or individuals, among which activities, without exhaustive intent, are the following:
a) Inform and advise on specific matters of security, energy efficiency, use of renewable energy sources, rehabilitation and accessibility to buildings.
b) Establish a validation system for qualified technicians with technical and financial solvency to assess the current situation of the buildings and propose the appropriate measures for eco-efficient rehabilitation and accessibility with an execution budget and a study of the savings planned for the beneficiaries.
c) Establish a system of validation of suppliers, contractors and qualified technical directors with technical and financial solvency with whom to contract the execution of all or part of the measures.
d) Establish a system for validating the technical specifications of the measures, equipment and materials to be installed.
e) Establish a system to verify that the formulas for financing the cost of the works are long-term and in the best market conditions for the beneficiaries.
f) Promote the creation of a guarantee fund to cover the contingencies for delays and non-payments that may be determined in front of the financial investors of the program.
g) Design and accredit a standard clause of general conditions of the contracts to be formalized between the intervenors, ensuring the maximum guarantees for the parties, especially for the beneficiaries when they have the status of consumers or users.
h) Advise the beneficiaries on the particular conditions of the contracts to be signed.
i) Establish mechanisms to guarantee the effectiveness of the works carried out.
j) Carry out agreements or other actions with City Councils and / or other public administrations in order to formalize the rights and obligations deriving from the interested beneficiaries who voluntarily join the program, providing those agreements and actions with the maximum mechanisms to ensure compliance of the obligations, implementing green credits or other modalities, according to what in each moment allows the rule.
k) Advise beneficiaries on obtaining tax credits and subsidies, especially in cases of energy poverty and long-term unemployed groups.
l) Check that the actions carried out have been carried out in accordance with the qualified project to which the beneficiaries have benefited.
m) Accredit and approve processes to improve energy safety and efficiency, the use of renewable energy sources as well as accessibility in buildings that promote other public and / or private entities that follow the guidelines and methodologies implemented by the Foundation in its own actions.
n) Attract and manage donations for the Foundation with the aim of promoting and expanding the scope of the Foundation’s actions and their social impact.
In the development of all its activities, the Foundation will implement all the criteria of corporate social responsibility that are appropriate to it.
Article 7. Basic rules for applying resources to purposes
The income and other annual income obtained by the Foundation must be used to fulfill the purposes of the foundation within the limits established by current legislation.
The Foundation may carry out all kinds of economic activity, acts, contracts, operations and lawful business, without further restrictions than those imposed by the applicable legislation.
Article 8. Basic rules for determining beneficiaries
Beneficiaries of the Foundation are:
a) all owners and / or holders of real rights and communities of owners over buildings located within the geographical area of the scope of action, who meet the requirements to be candidates for the program.
b) all public and / or private entities wishing to promote qualified programs verified by the Foundation with regard to the improvement of energy security and efficiency and the use of renewable energy sources as well as the rehabilitation and accessibility of buildings .
The Board of Trustees will approve the protocol of objective requirements that must be met by the beneficiaries who wish to take part in the program, in accordance with the principles of impartiality and non-discrimination, according to the following criteria:
a) Non-discrimination on the grounds of geographical origin or residence.
b) Non-discrimination on the grounds of sex.
c) Non-discrimination on grounds of age, from the age of majority.
d) Non-discrimination on the grounds of political or religious choices.
e) In the case of legal beneficiaries, care shall be taken to ensure that the entity does not act in a discriminatory manner in any of its activities.
